Submitting to the qualified voters of Missouri an amendment repealing section 49 of article III of the Constitution of Missouri, and adopting one new section in lieu thereof relating to the general assembly.
Be it resolved by the House of Representatives, the Senate concurring therein:
That at the next general election to be held in the state of Missouri, on Tuesday next following the first Monday in November, 2012, or at a special election to be called by the governor for that purpose, there is hereby submitted to the qualified voters of this state, for adoption or rejection, the following amendment to article III of the Constitution of the state of Missouri:
Section A. Section 49, article III, Constitution of Missouri, is repealed and one new section adopted in lieu thereof, to be known as section 49, to read as follows:
Section 49. 1. The people reserve power to propose and enact or reject laws and amendments to the constitution by the initiative, independent of the general assembly, and also reserve power to approve or reject by referendum any act of the general assembly, except as hereinafter provided.
2. Notwithstanding any other provision of this constitution to the contrary, no changes to any new statutory language or any amended language to an existing statutory provision as approved by a majority of the voters voting thereon shall be approved by the general assembly unless the percentage of votes in favor of such changes in each chamber equals or exceeds the percentage of votes on the original measure as submitted by the voters.
