To amend chapter 407, RSMo, by adding thereto one new section relating to the purchase of catalytic converters, with a penalty provision.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 407, RSMo, is amended by adding thereto one new section, to be known as section 407.304, to read as follows:
407.304. 1. Every scrap metal dealer purchasing catalytic converters or any person seeking to refine platinum from catalytic converters shall keep a register containing a written or electronic record of each purchase. Seller shall present a valid photo identification. The buyer shall record the information from the seller's identification in the transaction register.
2. The records required under this section shall be maintained for a minimum of twenty-four months from when such material is obtained and shall be available for inspection by any law enforcement officer.
3. No scrap metal dealer or person seeking to refine platinum from a catalytic converter shall purchase or receive more than one catalytic converter per day from the same person except from a motor vehicle dealer as defined in section 301.550.
4. Anyone convicted of violating this section shall be guilty of a class A misdemeanor punishable only by fine. Nothing in this section shall be construed to preclude a person violating this section from also being prosecuted for any applicable criminal offense.
5. This section shall not apply to sales transactions of catalytic converters between a scrap metal dealer and a motor vehicle dealer as defined in section 301.550.
