AN ACT
To amend chapter 33, RSMo, by adding thereto one new section relating to the commission on state expenditures.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 33, RSMo, is amended by adding thereto one new section, to be known as section 33.205, to read as follows:
33.205. 1. There is hereby created the "Commission on State Expenditures" which shall consist of seven members. Three members shall be appointed by the president pro tem of the senate and three members shall be appointed by the speaker of the house of representatives. One member shall hold a doctorate in economics or finance, or a related field, and shall be appointed jointly by the president pro tem of the senate and the speaker of the house of representatives. The president pro tem and speaker shall have total discretion in the appointment of members to the commission, but all members shall be citizens of this state.
2. Members of the commission shall serve for a two-year term beginning the first of February 2011. If any vacancy occurs on the commission for any reason, the vacancy shall be filled in the same manner as members originally appointed and the newly appointed member shall vacate his or her term of office at the end of the original member's term.
3. The commission shall review and make recommendations concerning state expenditures proposed for appropriation in the budget. The commission may use budget estimates when proposing changes to the state appropriations process or proposing modifications to statutes or rules. The commission may also make recommendations concerning political subdivision practices and expenditures, state agency practices and expenditures, federal moneys and grants, and changes to this state's statutory and regulatory regimes. The goal of the commission shall be to identify unnecessary or excessive expenditures and to recommend a course of action to reduce or eliminate such expenditures. Upon completion of the required analysis of the state budget and any discretionary analysis concerning other matters, the commission shall compile an annual report entitled "Recommendations on Missouri Expenditures". The report shall be provided to the governor, the president pro tem of the senate, and the speaker of the house of representatives by the first of February 2012 and each subsequent year.
4. No member of the commission shall receive compensation for his or her service, but members may be reimbursed for their actual and necessary expenses incurred while serving as members of the commission. Upon request of the commission, the office of administration shall provide staff to assist the commission in the performance of its duties. Subject to appropriation, the commission may employ such staff as it deems necessary for the performance of any of its duties.
5. The commission shall have the authority to choose its own rules of practice and procedure. A constitutional majority of the members of the commission consisting of at least four members shall be required to adopt rules of practice and procedures and to approve the report required under subsection 3 of this section.
