AN ACT
To amend chapter 68, RSMo, by adding thereto one new section relating to port authorities.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 68, RSMo, is amended by adding thereto one new section, to be known as section 68.075, to read as follows:
68.075. 1. This section shall be known and may be cited as the "Advanced Industrial Manufacturing Zones" or "AIM".
2. As used in this section, the following words shall mean:
(1) "AIM zone", an area which is being developed or redeveloped for any purpose so long as any infrastructure and building built or improved in the development area is a:
(a) High performance base building;
(b) High performance tenant building;
(c) High performance whole space;
(2) "Base building", all areas of a building not intended for occupancy by a tenant or owner, including, but not limited to, the structural components of the building, exterior walls, floors, windows, roofs, foundations, chimneys and stacks, parking areas, mechanical rooms and mechanical systems, and owner-controlled or operated service spaces, sidewalks, main lobby, shafts and vertical transportation mechanisms, stairways, and corridors;
(3) "Green Globes", an environmental assessment and rating tool for green buildings developed by the Green Building Initiative;
(4) "High performance base building", a base building that meets all requirements in the most current version of the United States Green Building Council's LEED-CS or that meets the most current requirements for at least a three globes rating under Green Globes;
(5) "High performance tenant space", a tenant space as defined under subdivision (12) of this subsection that meets:
(a) All requirements in the most current version of the United States Green Building Council's LEED-CI; or
(b) The most current requirements for at least a three globes rating under Green Globes;
(6) "High performance whole building", a whole building that meets:
(a) All requirements in the most current version of the United States Green Building Council's LEED-NC, as amended from time to time; or
(b) All requirements in the most current version of the United States Green Building Council's LEED-EB; or
(c) The most current requirements for at least a three globes rating under Green Globes;
(7) "LEED", the Leadership in Energy and Environmental Design green building rating system and guidelines developed by the United States Green Building Council;
(8) "LEED-CI", the most current rating system guidelines developed for commercial interiors;
(9) "LEED-CS", the most current LEED rating system guidelines developed for the core and shell of buildings otherwise known as the base building;
(10) "LEED-EB", the most current LEED rating system guidelines developed for existing buildings;
(11) "LEED-NC", the most current LEED rating system guidelines developed for new construction and major renovations;
(12) "Tenant space", the portion of a building intended for occupancy by a tenant or occupying owner;
(13) "United States Green Building Council", the specific council which measures and evaluates the energy and environmental performance of a building according to its own Leadership in Energy and Environmental Design rating system;
(14) "Whole building", the entire building, composed of the base building and tenant space.
3. There is hereby created in the state treasury the "Port Authority AIM Zone Fund", which shall consist of money collected under this section. The state treasurer shall be custodian of the fund and shall approve disbursements from the fund in accordance with sections 30.170 and 30.180. Upon appropriation, money in the fund shall be used solely for the administration of this section. Notwithstanding the provisions of section 33.080, to the contrary, any moneys remaining in the fund at the end of the biennium shall not revert to the credit of the general revenue fund. The state treasurer shall invest moneys in the fund in the same manner as other funds are invested. Any interest and moneys earned on such investments shall be credited to the fund.
4. Fifty percent of the employment taxes directly attributed to new jobs created within such zone after development or redevelopment has commenced shall not be remitted to the state of Missouri. Such moneys shall be deposited into the port authority AIM zone fund established under subsection 3 of this section for the purpose of continuing to expand, develop, and redevelop the AIM zone in an energy efficient manner.
5. Any port authority located in Missouri may establish a AIM zone. Such zone may include any portion of the area within the port authority's jurisdiction. The port authority shall determine the boundaries for each AIM zone, and more than one AIM zone may exist within the port authority's jurisdiction.
6. The port authority shall approve any projects and disperse any money collected under this section. The port authority shall submit an annual report to the department of economic development explaining how it obtained its portion of employment taxes, how such money is going to be spent, and when such money is going to be spent.
