AN ACT

To amend chapter 43, RSMo, by adding thereto one new section relating to criminal history searches for persons seeking to work or volunteer at camps which provide activities for children under the age of eighteen.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 43, RSMo, is amended by adding thereto one new section, to be known as section 43.544, to read as follows:

            43.544. Any person, business, or organization, whether public or private, for profit, not for profit, or voluntary that holds camps which provide activities for children under the age of eighteen shall submit two sets of fingerprints to the Missouri state highway patrol, Missouri criminal records repository, for the purpose of checking any person's criminal history that will work in the camps whether on a paid or voluntary basis. The first set of fingerprints shall be used to search the Missouri criminal records repository and the second set shall be submitted to the Federal Bureau of Investigation to be used for searching the federal criminal history files if necessary. The fingerprints shall be submitted on forms and in the manner prescribed by the Missouri state highway patrol. Fees assessed for the searches shall be paid by the person, business, or organization which holds the camps or by the individual seeking to work in the camps at the discretion of the person, business, or organization holding the camps. Notwithstanding the provisions of section 610.120, all records related to any criminal history information discovered shall be accessible and available to the person, business, or organization making the record request.
