To amend chapter 42, RSMo, by adding thereto one new section relating to veterans.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 42, RSMo, is amended by adding thereto one new section, to be known as section 42.250, to read as follows:
42.250. 1. Notwithstanding any other provision of law any veteran may request not to work on Veterans Day and any employer in this state shall grant such request from a veteran as long as the following conditions are met:
(1) The veteran must submit proof of his or her status as a veteran to the employer a minimum of thirty calendar days prior to the first Veterans Day that he or she is requesting off. After that as long as a veteran remains working for the same employer he or she does not have to resubmit proof of his or her status as a veteran in order to have Veterans Day off in succeeding years; and
(2) The veteran must submit a request not to work on a particular Veterans Day, in writing, a minimum of thirty calendar days prior to that particular Veterans Day.
2. No employer shall take any adverse action regarding such veteran's employment as a result of a veteran exercising his or her right to not work on Veterans Day.
3. Any veteran may exercise his or her right to not work on Veterans Day without loss of position, seniority, accumulated leave, impairment of performance appraisal, pay status, work schedule including shift, working days, and days off assigned to the veteran, and any other right or benefit to which the veteran employee is entitled, and no retirement benefit shall be diminished or eliminated because of the veteran not working on Veterans Day.
