HB 904 -- Passing of Bad Checks

Sponsor: Hosmer

The bill requires bad check charges to be dismissed if the check
is paid in full within 10 days of the service of summons or
warrant.

The bill also clarifies that passing a bad check in whole or
aggregated amounts of less than $150 is an infraction. Under
the bill, it is a class D felony to pass a bad check or sight
order in whole or aggregated amounts of more than $500. Current
law makes it a class A misdemeanor to pass a bad check or sight
order in whole or aggregated amounts of $150 or more. In
addition, it is currently a class D felony to pass a fraudulent
check.
