Summary of the Truly Agreed Version of the Bill

SCS SB 901 -- ENVIRONMENTAL CONTROL

This bill changes the regulatory authority of the Department of
Natural Resources on underground storage tanks from the Clean
Water Commission to the Hazardous Waste Management Commission.

The department can adopt rules and regulations more stringent
than those of the United States Environmental Protection Agency.
Any rule, except those made by the Petroleum Storage Tank
Insurance Fund board of trustees, will be adopted after due
notice as required by Chapters 260 and 536, RSMo.  Section
260.370 will prevail over Section 644.143 or Section 644.026(8)
if there is a conflict concerning authority for the risk-based
remediation rule.
