Summary of the House Committee Version of the Bill

HCS SCS SB 1336 -- MISSOURI MILITARY FAMILY RELIEF

SPONSOR:  Kennedy (Bruns)

COMMITTEE ACTION:  Voted "do pass by consent" by the Committee on
Tax Policy by a vote of 14 to 0.

This substitute creates the Missouri Military Family Relief Fund
in the state treasury.  The fund will be administered by the
Missouri Adjutant General who can make, subject to
appropriations, grants from the fund to families of persons who
are members of the Missouri National Guard or Missouri residents
who are members of the reserves of the armed forces of the United
States and have been called to active duty between September 11,
2001, and December 31, 2010, by the President of the United
States.

In addition to state appropriations, in each taxable year
beginning January 1, 2004, Missouri residents and corporations
can designate a minimum contribution of $1 on a single return or
$2 on a combined return to be credited to the fund from their
refund amount or by separate payment.

The Director of the Department of Revenue is required to transfer
the contributions on a monthly basis, less 1% of the amount in
the fund at the time of the transfer during Fiscal Year 2005, to
the State Treasurer for deposit into the fund.  The amount
transferred will be for Fiscal Year 2005 only and will not exceed
$70,000.  Any moneys remaining in the fund at the end of the
biennium will not revert to the credit of the General Revenue
Fund.

The provisions of the substitute will expire six years from the
effective date.

FISCAL NOTE:  Estimated Effect on General Revenue Fund of an
income of $745 to a cost of $69,255 in FY 2005, $0 in FY 2006,
and $0 in FY 2007.  No impact on Other State Funds in FY 2005, FY
2006, and FY 2007.

PROPONENTS:  Supporters say that the bill assists families of the
Missouri National Guard and reserve members while they are on
active duty.  One-third of the deployed members earn less than
they do in their civilian job.

Testifying for the bill were Senator Kennedy; Office of
Lieutenant Governor; Office of Adjutant General; and Missouri
National Guard Association.

OPPONENTS:  There was no opposition voiced to the committee.
