To amend chapter 383, RSMo, by adding thereto one new section relating to medical malpractice insurance.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 383, RSMo, is amended by adding thereto one new section, to be known as section 383.525, to read as follows:
383.525. 1. Notwithstanding any other provision of law, any licensed physician who is the medical director of a Special Weapons and Tactics (SWAT) team which has written medical protocols for the team and medical services rendered in the field shall be eligible for coverage under a medical malpractice insurance policy for services rendered as the medical director of a SWAT team.
2. The medical director of a SWAT team, his or her agents, or his or her employees acting in their professional capacity shall not be liable for any civil damages or administrative sanctions for any failure, in the delivery of medical services necessitated by the activities of the SWAT team, to exercise the skill and learning of an ordinarily careful health care provider in similar circumstances, but shall be liable for damages due to willful and wanton acts or omissions in rendering such services.
